The domain https://www.foodiestay.com is owned by the company Foodiestay, S.L., with registered address at Calle Fuencarral, nº 104, 2º D, 28004, Madrid, Spain (hereinafter Foodiestay), a company which is also responsible for processing the personal data supplied by Users through this website.
Here, in addition to indicating the person responsible for the treatment, we will refer you to our practices to protect the privacy of your personal data, for what purpose the personal information you provide us will be treated, why we are legitimate for its treatment, the way in which we collect your data and why. As well as their use, their rights as users and also explain the processes we have put in place to protect your privacy.
By providing us with your personal information and using our websites, we understand that you have read and understood the terms related to the personal data protection information presented. At Foodiestay we assume responsibility for complying with current national and European data protection legislation, and we aim to treat your data lawfully, fairly and transparently.

2. Responsible for processing


Foodiestay, S.L., a company of Spanish nationality and domiciled in Spain, is responsible for the processing of data and personal information collected from its users. To be responsible for the treatment supposes that it is the person, in this case, juridical that, alone or with other people, determines the ends and means of the treatment.
In order to contact the person responsible for the treatment, as well as to exercise their rights in the matter of protection of the data that they facilitate to us, contact in the following direction of electronic mail: lopd@foodiestay.es.

 

3. Purpose of obtaining your personal data


3.1. The main reason why we request your personal data is because they are necessary for (i) in the case of Gastronomic Expert Users, to register them as such and for the development of our commercial and business relationship in the publication and management of their Gastronomic Offers through our Platform and (ii) in the case of Users interested in Gastronomic Offers, to give course to your orders, that is to say to manage your request of contracting and reservation of the offers of gastronomic experiences that offer the Gastronomic Expert Users, with whom we put them in contact and with those who contract each gastronomic experience, through our Web and to be able to attend to him suitably and to communicate any question or incidence to him.
In the event that you register voluntarily on the website or do so to place an order, but then desist, and therefore contract or not any Gastronomic Offer, your data will serve us, provided you have authorized us to send advertising of other gastronomic experiences or services hosted on our website. Advertising that we would carry out by electronic means (even in an automated way) being able to personalize it to your preferences by means of the creation of a profile on the basis of both the information provided and the contracts made.
In summary, in order to carry out commercial communications, in some of the electronic forms you may be asked for your express consent to be able to send commercial communications by any means, including electronic mail or equivalent electronic means of communication, in accordance with the provisions of article 21 LSSI. Without such consent we would not do so.


3.2. Data of Minors. The website of Foodiestay, S.L. and the gastronomic experiences offered are not aimed at minors, so we do not collect any personal information from minors deliberately, if not with the permission of the parent or guardian. If you are a minor, please do not attempt to register as a user of our website. If we discover that we have mistakenly obtained personal information from a minor, we will delete such information as soon as possible.


3.3. This Privacy Policy also applies to the Payment Services that Foodiestay provides to Users in accordance with the provisions of the General Terms and Conditions. When you use the Payment Services, you are also providing your details, including your personal details, to Foodiestay who will also act as Data Processor for your information relating to the Payment Services on the basis of your country of residence.


3.4. Information requested to become a User of the Foodiestay Website:
Foodiestay requests and collects the following personal data from the different Users when they register in the Foodiestay Platform, as it is necessary information for the execution of the contract formalized between the Users contacted through this Platform and that allow Foodiestay to fulfill the contractual obligations arising from the ownership of the Platform.


3.4.1 Gastronomic Expert Users (natural persons)
- Name and surname, address, e-mail address, mobile phone, Tax Identification Number, date of birth, preferred language,
-Place(s) where the experiences will be carried out
-Information of the content and characteristics, including photographs, of the Gastronomic Offers that are uploaded to this Platform.
- Bank details to make the corresponding payments.


3.4.2. Users of the Gastronomy Offers and Voluntary Users
- Name and surname, address, e-mail address, mobile phone and tax identification number and date of birth.
- Bank details so that you can make the corresponding payments for the acceptance of one or more Offers.
- Also, while using this Platform we automatically collect personal information about the services you use, even if you have not registered as a User. This information will be used in cases where you have marked your interest in receiving advertising from Foodiestay Gastronomic Offers. In the same way, when the User uses certain functions of the Platform, we may collect information about your precise or approximate location from data such as your IP address or the GPS of your mobile device to provide you with a better user experience. Most mobile phones allow you to control or disable the use of location services for applications in the device settings menu. We may also collect this information when you are not using the application if location services are enabled in your device's settings menu or in your device's permissions.

 

4. Legitimation of Foodiestay, S.L. for the treatment of personal data


The legitimacy of Foodiestay, S.L. for the processing of your personal data is based on the following reasons:
Regarding Gastronomic Expert Users: (i) to contract with Foodiestay, (ii) so that they can offer Gastronomic Experiences to the Users of the Foodiestay website; and/or (iii) to facilitate the contact of the Gastronomic Expert Users with the Users of Gastronomic Offers facilitating the accomplishment of the orders.
With respect to the Users of Gastronomic Offers, to facilitate the fulfillment by the Gastronomic Expert Users of their contractual obligations derived from the orders formulated by the Users of the Gastronomic Offers. 
If you give us your consent, to send advertising or personalized offers of our experiences.


5. Recipients of your personal information. International transfer


The acceptance of an Offer of a Gastronomic Experience will require the cession of its data to the Gastronomic Expert Users who will provide the service offered in this Platform. Therefore, it may be necessary and mandatory for the provision of the service, that their data have to be communicated to the different Gastronomic Expert Users, who will be obliged to use the data, solely and exclusively, to comply with the object of the contract.
Initially the Gastronomic Expert Users are not located in third countries what would make necessary to carry out an international transfer of data. Although, if this happens in the future, Foodiestay assumes responsibility for the personal information you provide, forcing us to require these Gastronomic Expert Users to apply the same degree of protection of information as Foodiestay, S.L.
Finally, your personal data will be at the disposal of the Administration and of the Courts and Tribunals, for the attention of the possible responsibilities born from the treatment.
Except for what is referred to in the previous paragraphs, we do not plan to transfer data to third countries. The personal information that the users send us is located in Spain, and although we have presence in the countries where the gastronomic experiences are carried out if your personal information is collected in another country, then we install and store this information in our systems located in Spain. Those third parties with whom we share your personal information may only manage or transfer your personal information outside of Spain and the European Union to other countries where they have facilities, in this case complying with the requirements established by the Spanish Data Protection Agency and the European Union.
We will comply with applicable law with respect to any transfer of your personal information that we or those third parties with whom we share your personal information, and with respect to the way in which we manage your personal information. In any event, the transfer, storage and management of your personal information by us will always be governed by this Privacy Policy.

  6.2. Time during which we will store your personal data. We only store your personal information to the extent that we need it in order to be able to use it according to the purpose for which it was collected, and according to the legal basis for processing it in accordance with applicable law. We will keep your personal information for as long as there is a contractual and/or commercial relationship with you, or as long as you do not exercise your right of deletion, cancellation and/or limitation of the processing of your data.
In these cases, we will keep the information properly blocked, without giving it any use, as long as it may be necessary for the exercise or defence of claims or it may derive some type of judicial, legal or contractual responsibility of its treatment, which must be attended and for which its recovery is necessary. You can change the way we contact you by any of the following means: (i) by written and signed request addressed to Foodiestay, S.L., at C. Fuencarral nº 104, 2º, 28004 - Madrid (Asesoría Jurídica - Protección de Datos), attaching a photocopy of the applicant's DNI; (ii) by sending the request together with a scanned copy of the applicant's DNI to the e-mail address lopd@foodiestay.es.

 

8. Recommendations and precautions


These are some of the precautions and recommendations that we advise our Users to take: 
Do not give the user or the password to anyone; 
Do not write down the password in places of easy access: computer, agenda; 
Always use our SSL security system, and 
always disconnect the browser session after entering the username or password into the system.
